AI Suite Terms of Service

These Terms apply to PhotoToDance AI generation features at phototodance.com, including Studio (motion-copy video) and the Spicy Image Editor. They supplement the general Site Terms. If there is a conflict for AI generation, these AI Suite Terms control. This is not legal advice; consult counsel for your jurisdiction.

1. Scope and acceptance

By signing in with Google, purchasing credits, uploading media, or using Studio or the Image Editor, you agree to these Terms, the AI Suite Privacy Policy, and the site Privacy Policy and Refund Policy. If you do not agree, stop using the AI Suite immediately.

IF YOU ARE UNDER 18, YOU MAY NOT USE THE AI SUITE UNDER ANY CIRCUMSTANCES.

2. Eligibility and age

The AI Suite is for adults 18+ (or the age of majority where you live, if higher). You affirm under penalty of account termination that you meet this requirement. You are responsible for ensuring use is lawful in your jurisdiction. Accounts are personal and non-transferable.

3. Description of service

PhotoToDance provides cloud AI tools. Processing uses third-party infrastructure. When you submit a job:

Studio — you upload a reference video and character image; we run a Wan 2.2 ComfyUI pipeline on GPU hosts (e.g. RunPod) and store inputs/outputs on Cloudflare R2.
Spicy Image Editor — you upload a reference image and prompt; we send the request to MuleRouter (Qwen Image Edit Max). Safety filtering may be disabled for this product. Inputs/outputs are stored on Cloudflare R2.
Job records (prompt, status, credit amounts, IP, timestamps, result URLs) are stored in our database (Cloudflare D1).

Use of the AI Suite is consent to these data flows as described in the AI Suite Privacy Policy.

4. Accounts and authentication

Authentication uses Google OAuth. We receive your Google account identifier, name, email, and profile picture as provided by Google. SuperAdmin accounts may use a separate username/password. You are responsible for all activity under your account.

5. Credits, payments, and billing

5.1 Shared wallet

Studio and Image Editor use one credit wallet. Credits may be purchased via Payhip (card/PayPal), NOWPayments (crypto), or manual GCash top-ups reviewed by staff. Optional credit plans grant bonus credits into the same wallet and may include a limited number of daily free Image Editor uses for 30 days from purchase (unused daily free edits do not roll over; free uses end when the plan window expires). Wallet credits themselves do not expire.

5.2 When credits are charged

Studio videos — credits are reserved when a job starts and charged when the video completes successfully. Failed video jobs that never produce a billable completion typically release the reservation.
Image Editor — credits are reserved when you submit an edit. Credits are non-refundable after generation starts (after the third-party provider accepts the job). If the provider never accepts the job, reserved credits are released. If the provider accepts the job but generation fails or output is unsatisfactory, a portion of credits may be retained to cover provider costs, and any unused reserve may be released automatically.

5.3 No guarantee of output quality

AI outputs may be imperfect, filtered, empty, or undesirable. Except for automatic releases described above, we do not refund for quality, taste, or policy rejections by third-party providers.

5.4 SuperAdmin

SuperAdmin accounts may be exempt from wallet charges for operational testing.

6. Content policy — prohibited uses

6.1 Zero tolerance

You may not use the AI Suite to create, process, or distribute:

Any sexual, suggestive, romantic, or exploitative content involving minors (under 18), real or fictional — zero exceptions
Non-consensual intimate imagery or “revenge porn”
Deepfakes or likenesses of real people without their explicit consent
Content designed to harass, stalk, defame, or intimidate
Content that violates applicable law

Violations may result in immediate permanent ban, forfeiture of credits, deletion of content, and cooperation with law enforcement where required.

6.2 Adult / explicit content (Image Editor)

The Spicy Image Editor can produce adult content. By using it you confirm you are 18+, accept sole responsibility for prompts and outputs, ensure depicted subjects are clearly adult, and comply with platform rules when sharing outputs.

6.3 Face and identity

When uploading photos of people, you certify you have the right and consent to use that likeness. Uploads may be logged with your account and IP for abuse prevention.

7. Third-party providers

Depending on the feature, your prompts and media may be transmitted to:

RunPod / GPU hosts — Studio video generation
MuleRouter — Spicy Image Editor inference
Cloudflare — Workers API, D1 database, R2 storage, Pages hosting
Payhip / NOWPayments — payments (they process payment data under their own policies)
Google — OAuth sign-in

Each provider has its own terms and privacy policy. We transmit only what is needed to fulfill your request.

8. Intellectual property

Subject to these Terms and applicable law, you are responsible for your uploads and generally own outputs you generate, to the extent ownership is recognized. PhotoToDance branding, software, and interfaces remain our property. You grant us a limited license to process, store, and deliver your uploads/outputs to operate the Service and enforce these Terms.

9. Disclaimers and limitation of liability

THE AI SUITE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. AI OUTPUTS MAY BE INACCURATE, OFFENSIVE, OR TECHNICALLY IMPERFECT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE AI SUITE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR CREDITS IN THE 90 DAYS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless PhotoToDance and its operators from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of the AI Suite, or your violation of these Terms or law.

11. Suspension and termination

We may suspend or terminate access, revoke approvals, or delete content for policy violations, fraud, chargebacks, or risk to the platform. Unused credits may be forfeited upon termination for cause.

12. Modifications

We may update these Terms by changing the “Last updated” date. Continued use after changes constitutes acceptance. Material changes to credit charging may also be reflected on the Pricing page.
