1. Agreement

These Terms & Conditions ("Terms") govern your use of PhotoToDance ("Service"), an AI-powered platform for copying motion from reference videos onto character images for TikTok, Instagram Reels, and similar short-form content. By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Refund Policy.

2. Eligibility

You must be at least 18 years old to use PhotoToDance. The Service is intended for adults only. By using the Service, you confirm that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

3. The Service

PhotoToDance provides pay-as-you-go access to AI motion-transfer video generation. You may generate:

• Videos — 720×1280 vertical motion-transfer videos from a reference clip and character image, powered by the Wan 2.2 pipeline

You upload a reference video (MP4, up to 15 seconds) and a character image (PNG or JPG). Generated outputs are stored privately and delivered through the Studio. Pricing is described on our Pricing page.

4. Wallet credits & billing

PhotoToDance uses a wallet credit model. All purchases must be made through our official website at phototodance.com.

• You top up wallet credits (minimum $5) via crypto (NOWPayments) or manual GCash with admin approval.
• Credits are reserved when you start a job and charged when it completes successfully.
• Failed jobs are not charged; reserved credits are released automatically.
• Pricing scales with reference video length ($0.08/s, $0.50 minimum per completed video).
• There is no monthly subscription.

5. Acceptable use

You agree not to use PhotoToDance to:

• Generate content depicting minors or any person without lawful consent
• Violate copyright, trademark, or publicity rights of third parties
• Create deepfakes or misleading content intended to deceive or harm others
• Upload malware, attempt to reverse-engineer the Service, or abuse rate limits
• Violate applicable laws

We reserve the right to suspend or terminate accounts that violate these rules.

6. Your content

You retain ownership of images and videos you upload. You grant PhotoToDance a limited license to process your uploads solely to provide the Service. Generated outputs belong to you, subject to applicable law and third-party model licenses. You are responsible for ensuring you have rights to all reference material you upload.

7. Refunds

Refunds for unused wallet balance may be available within 30 days of top-up. For full details on eligibility and how to request a refund, see our Refund Policy.

8. Service availability

Video generation runs on scale-to-zero GPU infrastructure (RunPod Serverless). Generation times vary based on queue load and input complexity. We do not guarantee uninterrupted availability but aim to provide reliable access. Scheduled maintenance may occur with reasonable notice where possible.

9. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind. AI-generated outputs may contain imperfections. We do not guarantee that outputs will meet your specific creative, commercial, or platform-compliance requirements.

10. Limitation of liability

To the maximum extent permitted by law, PhotoToDance shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
